Compliance not only protects our Advertiser and Agency clients but it also protects our Affiliates. As an industry we believe that it is important for everyone to comply with the law and respect the rights of third parties, in all aspects of performance marketing, which is why USM evaluates every advertisement before agreeing to provide traffic, USM screens Affiliates before giving them an account, and actively monitors traffic.
Our Compliance Guidelines for Advertisers and Agencies are simple: make sure that your advertisement, including all materials provided and linked to, complies with all applicable laws, regulations and does not violate the rights of any third parties. This means that your advertisement must not be false and deceptive, you must have proof to back up any claims you make in your advertisement, you have the necessary licenses, permits or authorization to run this advertisement and advertise your product or service, you cannot use any trademarked or copyrighted material without consent, and you must agree to indemnify USM for any violations of the law, regulations or rights of third parties.
Our Compliance Guidelines for Affiliates are based on one simple principal: Don't violate any laws! Compliance with the various laws and regulations which govern performance marketing can be easily followed and all of USM's Affiliate are required to strictly comply. Here are a few of the important guidelines USM requires its Affiliates to follow, however this list does not include all of the laws and regulations that Affiliates must follow and it is the Affiliates responsibility to ensure they are familiar with all applicable laws and regulations.
Affiliates must only use html/text creatives, from/subject lines provided by USM. Any changes to provided materials must be approved in writing by USM prior to use.
Affiliates must disclose upon request all Internet Protocol (IP) addresses which they use to conduct any performance marketing activities, including IPs used for sending email messages.
For any traffic generated through a social network Affiliates must comply with all rules and regulations of that social network.
For traffic generated via SEO Affiliates may not bid on any trademarked or copyrighted search terms or violate any intellectual property rights of any third party; and Affiliates must comply with any rules and regulations of the search provider.
For every type of traffic Affiliates must comply with each and every State and Federal law and regulation. Affiliate must be familiar with the laws that apply to their conduct and must strictly follow those laws. Affiliates who violate the law will face strict consequences
